Terms & conditions of use

Access to this Site and the use of information on it is subject to these Terms and Conditions. You should carefully read these Terms and Conditions before proceeding further. By proceeding further you will be deemed to have read and accepted them and will be bound by these Terms and Conditions.

Definitions

In these Terms and Conditions, the following terms shall have the meanings indicated:

• “Terms and Conditions” – means these terms and conditions of use of this Site
• “Bank of Ireland” – means The Governor and Company of the Bank of Ireland;
• “Bank of Ireland Group” – means Bank of Ireland Group plcand its subsidiaries and associates including Bank of Ireland;
• “Member” means any person who had a full time or part time contract of employment with any member of the Bank of Ireland Group and who has registered with Bank of Ireland Alumni Network through the Site;
• “Privacy Statement” means our statement of practice as regards the privacy and security of your information when accessing and/or using this Site and any of the features on the Site (you can read a copy of the Privacy Statement by clicking here);
• ‘Site’ means the microsite for Members contained on our website, http://www.bankofireland.com/alumni;
• “Submitted Content” means any information, materials, correspondence and other content that may be submitted to and published on the Site by you and other Members;
• “you” means any and all persons (including Members) accessing or using this Site and/or availing of any information and/or services available on or via this Site; and
• “we” and “our” and “us” means any member of Bank of Ireland Group as applicable;

1. About the Site

1.1. The Site enables Members to stay in touch with former colleagues and other Members and receive relevant content from Bank of Ireland Alumni. The Site is operated by us.

1.2. We may provide information regarding, or hyperlinks to, other relevant services, websites or webpages on this Site. These may be subject to their own terms and conditions, privacy and cookie statements.

1.3. Products and services (other than the Site) provided by any member of the Bank of Ireland Group may have their own terms and conditions which will be separate from these Terms and Conditions and which will form a separate legal agreement between you and that member of the Bank of Ireland Group.

1.4. These Terms and Conditions include the terms set out in our Privacy Statement (including any cookie policy available on the Site).

1.5. These Terms and Conditions are the entire agreement between you and us relating to the use of the Site.

2. Registration of Members

2.1. Registration as a Member of Bank of Ireland Alumni is currently available to individuals who have previously been employed by any member of the Bank of Ireland Group but have since left. By registering with the Site, you confirm that you have previously been employed by a member of the Bank of Ireland Group but have since left, and agree to these Terms and Conditions. If you do not meet these eligibility requirements, you must not attempt to register as a Member and we may refuse to register you or terminate your registration.

2.2. We reserve the right in future to extend or restrict the categories of Users who may become Members from time to time and at our sole discretion.

2.3. We reserve the right to prohibit any Member to access the Site in our sole discretion.

3. Access to the Site

3.1. We may at any time withdraw or update any of the content, facilities, features or functionality offered by or via the Site without prior notice.

3.2. The Site allows you to view content which we deem relevant for Members and register to receive communications from Bank of Ireland Alumni.

3.3. Any information and materials provided via the Site, including Submitted Content is provided on an “as is” and “as available” basis.

4. Submitted Content

4.1. You may submit content to the Bank of Ireland Alumni Office that you want to be considered for uploading on the Site. By submitting prospective content to the Bank of Ireland Alumni office you agree that Bank of Ireland may publish that information on the Site.

4.2. Submitted Content can only be uploaded by Bank of Ireland Alumni Programme Office staff. Submitted Content must be sent to alumnioffice@boi.com and Bank of Ireland will determine at its sole discretion whether to publish any Submitted Content on the Site.

4.3. Submitted Content must be free from errors, defects, viruses or other forms of harmful or malicious programs, components or macros. In addition Submitted Content must not be abusive, offensive, libellous or defamatory or be harmful to the reputation or brand of any member of the Bank of Ireland Group.

4.4. You must have all necessary permissions or licences prior to submitting any prospective Submitted Content.

4.5. You acknowledge that the Submitted Content that is ultimately made available through our Site:

(a) has not been created by or endorsed by Bank of Ireland Group and that Bank of Ireland Group has no control over and assumes no responsibility for Submitted Content; and

(b) Is made available for general informational purposes only and the availability of Submitted Content on the Site does not constitute a recommendation or solicitation to make any financial decision or enter into any other transaction.

5. Prohibited Use of Site

5.1. The information in this Site is not provided and should not be used in any State or jurisdiction where accessing or use of such information is prohibited, whether in the format in which it is presented in this Site or howsoever. If you have any doubt about the legality of your using this Site, you should not continue any further and immediately exit the Site.

5.2. Bank of Ireland Group accepts no liability arising from the use or viewing of the Site which is in contravention of the laws of the jurisdiction in which you are resident, domiciled or located. Residents of the Republic of Ireland only are eligible to access and use this Site and apply for the products listed.

5.3. Any person who is a minor or otherwise unqualified to be a party to a contract is not entitled to apply for any of the products listed on the Site.

5.4. Users of this Site must not use any software, devices or other technology to automatically process or “scrape” the Site or any related data or information.

6. Disclaimer as to the accuracy of information

6.1. Care has been taken in the preparation of the information contained on this Site. However, we do not make any representations or warranties as to the accuracy, completeness, timeliness, merchantability, fitness for a particular purpose of the information contained on this Site.

6.2. Any information whether or not is classified as “real time” may have stopped being current by the time it reaches you. Any opinions or comments expressed on this Site reflect our judgement at the date of issue and are subject to change without notice.

6.3. Any pricing is indicative and does not, and is not intended to, constitute either an offer to buy or sell or a representation that a purchase or sale can be affected at that price.

7.1. No member of the Bank of Ireland Group (or any other person involved with the provision and maintenance of this Site) takes any responsibility for the accuracy of the information provided on this Site. Use of such information is at the user’s sole risk.

7.2. No member of the Bank of Ireland Group accepts any liability for any loss or damage of any nature, including but not limited to loss of profits, goodwill, or any other type of financial or other pecuniary or direct or special indirect or consequential loss howsoever arising whether in negligence or for breach of contract or other duty as a result of:

(a) use of this Site, including but not limited to any electronic mail messaging and Internet communication that may arise from, in the course of or pursuant to such use; and/or

(b) reliance on the information contained in this Site, whether:

• downloaded or not;
• authorised or not.

7.3. While Bank of Ireland Group has taken all reasonable steps to ensure that the information, services and products contained on the Site are accurate, current and comply with relevant legislation and regulation, Bank of Ireland Group makes no representation or warranty or undertaking of any kind in relation to the analysis, information or commentary contained on this Site or the completeness, timeliness, merchantability, fitness for a particular purpose or accuracy of such information.

8. General Provisions

8.1. You acknowledge that you are solely responsible for the use to which you put this Site and any Submitted Content made available on the Site and all the results and information you obtain from it and that all liability is excluded to the fullest extent permitted by law.

8.2. Nothing in these Terms and Conditions shall exclude, limit or restrict and member of the Bank of Ireland Group’s duties or liabilities to you under legislation which regulates any conduct of business rules which the Bank of Ireland Group is bound to comply with.

9. Variation of content

9.1. We reserve the right in our absolute discretion at any time and without notice to remove, amend or vary any of the content which appears on any page of this Site, including any terms and conditions. Any changes to these Terms and Conditions will be posted on this Site and by continuing to use this Site following any such change you will agree to be bound by the revised Terms and Conditions.

10. Amendments

10.1. The contents of this Site, including these Terms and Conditions, any information contained on this Site and our Privacy Statement are subject to change and to being updated without notice from time to time.

11.1. This Site may contain hypertext links to websites not maintained by Bank of Ireland Group or any member of Bank of Ireland Group. No member of Bank of Ireland Group endorses or represents the reliability, accuracy, security, timeliness, completeness, merchantability, fitness for a particular purpose or quality of any information, goods, services, or products displayed or advertised on such other websites. Bank of Ireland Group has not verified the truth or accuracy of any content of such websites and no warranty or representation is given or made in respect of the accuracy or truth of the content on such other websites. No member of Bank of Ireland Group is or shall be (or be deemed to be) a party to any contract that you may or do enter into with the providers of such goods, services or products. You are reminded that different terms and conditions of use will apply to you as a user of such websites. 12. Governing Law and Jurisdiction

12.1. Information and products and services appearing on this Site are provided in accordance with and subject to the laws of Ireland and the laws of Ireland govern the conduct and operation of this Site.

12.2. The courts of Ireland have exclusive jurisdiction over all claims or disputes arising in relation to, out of, or in connection with these Terms and Conditions, the information contained on this Site, any use made of that information and any products taken out and/or services availed of. Any such claims or disputes shall be resolved in accordance with the laws of Ireland.

13. Data Protection

Bank of Ireland Group will use your personal data in the manner set out in its Privacy Statement and its general Data Privacy Notice (together the “Data Privacy Notices”). However, in the event of a conflict between the Data Privacy Notices and these Terms and Conditions, these Terms and Conditions shall prevail.

14. Security

14.1. Please note that Bank of Ireland Group cannot guarantee the privacy or confidentiality of information relating to you that passes over the Internet. In accessing this Site and in availing of any of the services/information available on or via this Site, you are deemed by these Terms and Conditions to accept that electronic mail messaging and Internet communication may not be free from interference by third parties and may not remain confidential.

14.2. In all circumstances the use by you of this Site is at your sole risk.

15. Right of Bank of Ireland Group to information on this Site

15.1. The information services and products contained on this Site and these webpages are, unless otherwise specifically stated, the property of Bank of Ireland Group. The information and material contained on this Site and these webpages, including the services and/or products are for personal use only and may not be copied, printed, published, transmitted, amended or reproduced in any form whatsoever without the prior consent of Bank of Ireland Group.

16. Important Information

Bank of Ireland Group reserves the right to suspend or withdraw access to the Site and/or webpages without notice at any time and accepts no responsibility for this Site and/or these webpages not being available at all times. No member of the Bank of Ireland Group (or any other person involved with the provision and maintenance of this Site) provides any warranty as to the freedom of this site from errors, defects, viruses or other forms of harmful or malicious programs, components or macros.

17. Copyright and Trade Marks

17.1. Bank of Ireland Group grants personal users permission (a license) to:

(a) Browse this material (including making such copies in RAM or other temporary storage device necessary to facilitate such browsing); or

(b) Print out hard copies and where you have availed of a service and/or effected a product retain an electronic copy for personal use.

17.2. All intellectual property rights associated with the webpages and their contents including services and/or products are reserved to Bank of Ireland Group and its licensors. This shall also apply, subject to alterations as necessary, to attempted access of the webpages and attempted use of information on them.

These Terms and Conditions of Use shall also apply, subject to alteration as necessary, to attempted access of the Site and attempted use of information on it.

19. Miscellaneous

19.1. In the event that any provision in these Terms and Conditions is held to be unenforceable or invalid, such provision shall be severed and the remaining provisions shall be enforceable to the fullest extent permitted by the laws of Ireland.

19.2. Clause headings in these Terms and Conditions of Use are for reference purposes only and shall not be used to construe or determine the meaning of any or all of these Terms and Conditions.
